Restitution and the Importance of Retaining Legal Counsel for Survivors (REPEAT)

A victim of child sexual abuse materials (CSAM) has the legal right to have his or her voice heard in criminal and civil proceedings, in both federal or state court, and to seek monetary compensation from every offender who views, possesses, or distributes sexually abuse images or videos depicting the victim. Victims are more likely to have access to recovery services and to obtain restitution when represented by lawyers who are familiar with the legal and support resources available to their clients. This session will provide an overview of options for victims seeking restitution, discuss how private attorneys can work collaboratively with prosecutors, mental health providers, and NCMEC to support survivors, and explore potential collateral legal issues that may arise in cases of exploitation through the distribution of images.
