Defense expert witnesses can be a challenge when prosecutors don't know where to begin with the cross-examination. This workshop will use real examples and clips from trial to examine effective ways to cross-examine a defense expert witness. Participants will learn how to research and prepare for the cross-examination before ever stepping into the courtroom, ways to structure the cross-examination to gain concessions where appropriate, ways to lock a witness into their testimony before confronting them with facts from the trial, and ultimately how to ensure that the jury knows that the expert's testimony is unreliable or irrelevant as applied to the facts of the case.
Learning Objectives:
Understand how to effectively and efficiently prepare for the cross-examination of an expert witness before entering the courtroom
Develop model practices for cross-examination utilizing the various techniques discussed in the workshop
Employ trial techniques that ensure the jury understands that the defense expert's testimony is either unreliable or irrelevant to the facts of a particular case
